Arizona Bill Would Legalize Sports Betting at Indian Casinos

January 24, 2019

Arizona is the first state to consider legalizing sports betting at only Indian casinos. A new State Senate Bill 1158 has been introduced that includes this paragraph:

'Each federally recognized Indian tribe that has a tribal-state gaming compact entered into pursuant to Chapter 6 of this title and that has tribal headquarters on Indian lands located in this state may operate sports betting as defined in Section 13-3301. No other person or entity may operate sports betting.'

Arizona Indian tribes have existing gaming compacts with the state that give them the exclusive right to offer gaming in Arizona. In exchange the state receives a percentage of the gaming revenue from each Indian casino.

If the state were to legalize sports betting at commercial venues, it would break the terms of the gaming compacts and result in a major loss of tax income currently paid by the tribes.

SB 1158 has been referred to the Senate Rules Committee for review.

Nine years after announcing its plan for a full-scale casino in the West Valley, and nine months after breaking ground, the Tohono O'odham Nation is making progress on its new Desert Diamond West Valley Casino.

Tribal officials announced Wednesday that the casino, which broke ground in December, will open by the end of 2019.

The casino is being built adjacent to the temporary casino the tribe opened in 2015, near 93rd and Northern avenues. The project is just one piece of the tribe's plan to transform its 135-acre property into a full-scale casino, resort and spa.

More than twice the size

The new $400 million casino will have table games along with slots. It will be much larger than the temporary casino, with a 75,000-square-foot casino floor compared with the 30,000-square-foot floor at the temporary location. It will also offer live bingo and have five restaurants.

This phase of the tribe's project includes the new casino, a service building and two parking garages. The structures will connect to the new casino and the old casino, which will be used as a storage warehouse when the new casino opens.

More than 300 people attended a 'topping off celebration' Wednesday in a giant tent set up near the casino's construction site, marking the completion of the casino's dome-like steel frame.

The completion of the casino will be a milestone for the Tohono O'odham Nation, which first announced its plan to build a Class III casino near Glendale in 2009.

Tribal officials at the event emphasized how glad they were to now have the support of surrounding cities, such as Glendale and Peoria. The tribe initially faced resistance from Glendale and other tribes, and eventually from state leaders. After years of lawsuits, tribal and state leaders reached a settlement last year.

'One of the things we have learned is that challenges bring us together,' said Edward Manuel, chairman of the Tohono O'odham Nation. 'This celebration is not about a building, because this project has connected us together.'

Resort to follow

Ruby Prieto, CEO of the Tohono O'odham Gaming Enterprise, said work on the on-site resort will start after the casino opens. That means resort construction could begin in early 2020, he said.

Prieto said he isn't sure if the resort will be built and ready to open in time for the Super Bowl in 2023, which will be hosted a few blocks from the site at State Farm Stadium.

Glendale Vice Mayor Lauren Tolmachoff, who attended the event, said she looks forward to seeing the land built out.

'It will be a huge economic engine for the West Valley and an integral piece of the Sports and Entertainment District,' Tolmachoff said.
